Privacy Policy

1. Information We Collect

When you create an account, we collect your name, email address, and phone number. When you list a property or register a vehicle, we collect the details you provide (address, vehicle info, unit specifications).

2. Identity & Verification Documents

To maintain platform trust, we collect verification documents including:

• Renters: Driver's license, auto insurance cards
• Hosts: Property insurance, utility bills, trust declarations

Documents are encrypted at rest using AES-128 encryption. Extracted text (names, policy numbers, dates) is stored in encrypted format. Original images are compressed, encrypted, and stored on our servers — never in plain form. We do not share documents with other users or third parties except as required by law.

3. Payment Information

Payment processing is handled entirely by Stripe. RentShift does not store credit card numbers, CVVs, or full card details on our servers. Stripe's PCI-DSS Level 1 compliance protects all payment data. Your card is saved securely by Stripe for damage protection — RentShift never sees your card number.

4. Location Data

Property addresses are geocoded for search functionality. In search results, coordinates are offset by approximately 0.3 miles to protect host privacy. Exact addresses are only revealed to renters after a confirmed booking. Listing titles show street name only (no house number).

5. How We Use Your Information

• To facilitate bookings between renters and hosts
• To verify identity and build platform trust
• To process payments and issue host payouts
• To send booking confirmations, payment receipts, and cancellation notices
• To notify you when insurance is expiring or has expired
• To improve our platform and user experience

6. Data Sharing & Contact Information

We protect your privacy while enabling communication needed for bookings:

• Email addresses are never shared between renters and hosts. All platform emails come from RentShift, not from other users.
• Phone numbers are shared between renter and host only after a booking is confirmed. Phone numbers are visible during the booking period (confirmation through check-out) and hidden after the rental ends.
• Full address of the property is shared with the renter only after booking is confirmed, along with a directions link.
• Financial details are separated — renters see payment amounts, hosts see payout amounts. Neither party sees the other's financial information.

By completing a booking, you consent to this limited sharing for the purpose of coordinating access to the rental space. We do not sell personal data to third parties.

7. Email Communications

We send transactional emails only — booking confirmations, cancellation notices, payment receipts, insurance expiry warnings, and payout confirmations. These are required notifications tied to your account activity. We do not send marketing emails.

8. Data Retention & Deletion

You may request deletion of your account and associated data by contacting [email protected]. Verification documents are retained for 90 days after account deletion for legal compliance, then permanently deleted. Booking history and transaction records are retained for tax and legal compliance for the period required by applicable law.

9. Your Privacy Rights (Texas Residents)

Under the Texas Data Privacy and Security Act (TDPSA), Texas residents have the following rights with respect to their personal data:

• Right to Know / Access: You may request confirmation of whether we process your personal data, and a copy of that data.
• Right to Correct: You may request that inaccurate personal data we hold be corrected.
• Right to Delete: You may request deletion of your personal data, subject to exceptions for legal compliance, fraud prevention, and the verification document retention described in Section 8.
• Right to Data Portability: You may request a copy of your personal data in a portable, machine-readable format where technically feasible.
• Right to Opt Out: You may opt out of the sale of personal data, targeted advertising, and certain forms of profiling. RentShift does not sell personal data, does not engage in targeted advertising, and does not profile users for decisions producing legal effects.

Residents of other U.S. states with comprehensive privacy laws (including California, Virginia, Colorado, Connecticut, and Utah) are afforded substantially similar rights under those laws.

10. How to Submit a Privacy Request

Send a privacy request to [email protected] with the subject line "Privacy Request" and identify the right you are exercising. We will:

• Acknowledge your request within seven (7) days.
• Verify your identity using information already on file (email, phone, account activity).
• Respond substantively within forty-five (45) days, or notify you of an extension if the request is unusually complex.
• Process the request at no cost, except for repeated, manifestly unfounded, or excessive requests.

If we deny a request, you have the right to appeal that decision. To appeal, reply to the denial email with the subject "Privacy Appeal" within thirty (30) days of receiving the denial.

11. Children's Privacy

RentShift is not intended for use by anyone under the age of 18. We do not knowingly collect personal information from anyone under the age of 13. If you are a parent or guardian and believe a child under 13 has provided us with personal information, contact us at [email protected] and we will promptly delete that information.

12. Cookies & Local Storage

RentShift uses your browser's local storage and session storage to support core platform functionality:

• Authentication tokens — JWT access and refresh tokens for keeping you signed in.
• Search state — your most recent search location and dates so the page restores cleanly after navigation.
• Cached configuration — slow-changing public data like pricing limits.

We do not use third-party advertising cookies or cross-site tracking. You can clear local storage at any time through your browser's privacy settings; doing so will sign you out and clear cached search state.

13. Security & Breach Notification

We use industry-standard practices to protect your data, including encryption at rest (AES-128 for verification documents), TLS encryption in transit (HTTPS), and access controls limiting who can view sensitive data. No system is perfectly secure. If we become aware of an unauthorized acquisition of unencrypted personal information that materially affects you, we will notify you without unreasonable delay — and in any event no later than seventy-two (72) hours after confirmation — and will follow all applicable state-law breach notification requirements.

Terms of Service

1. Acceptance

By creating a RentShift account or using our platform, you agree to these Terms of Service. If you do not agree, do not use RentShift. You must be at least 18 years old to use RentShift.

2. RentShift Is a Marketplace, Not a Party to the Rental

RentShift is an online marketplace that connects renters seeking parking and garage spaces with hosts who own or control those spaces. The rental agreement is between the renter and the host. RentShift does not own, control, manage, inspect, or take possession of any space listed on the platform. We do not act as a real estate broker, property manager, leasing agent, or insurer, and we are not a party to any rental transaction between users.

3. Accounts & Verification

You must provide accurate information when registering. Renters must upload a valid driver's license and active vehicle insurance before booking. Hosts must provide proof of property insurance and confirm authorization to rent the space (including compliance with their lease, HOA rules, and local zoning). RentShift reserves the right to reject documents, suspend accounts, or refuse service for any reason permitted by law, including suspected fraud or violation of these Terms.

4. Bookings & Payments

• Authorization: When you book, your card is authorized (held) but not charged immediately.
• Capture: Your card is charged on the capture date (up to 6 days after booking or on check-in, whichever is first).
• Renter service fee: A 10% service fee is added to each booking and clearly displayed before payment.
• Host platform fee: A 5% platform fee is deducted from the host's payout. Hosts see their net payout amount in booking confirmations.
• Host payouts: Hosts receive payouts (rental minus 5% platform fee) via Zelle after the rental period completes.
• Tax responsibility: Applicable sales, use, lodging, or income taxes on the rental are the host's responsibility. RentShift may report host earnings to tax authorities as required by law.

5. Cancellation Policy

• Free cancellation: Cancel before the capture date for a full refund (hold released).
• Policy-based: After capture, refund depends on the listing's cancellation policy (Flexible: 100% rental refund, Moderate: 80% rental refund). Platform fee is non-refundable after capture.
• No refund zone: Cancellations within 2 days of check-in receive no rental refund.

6. Damage & Saved-Card Authorization

Renters' cards are saved securely at booking via our payment processor for damage protection. No upfront damage deposit is charged. If a host files a damage claim after checkout with photographic evidence, RentShift's role is limited to (a) reviewing whether the claim falls within platform guidelines, (b) facilitating communication between renter and host, and (c) — at the host's request and only after both parties have had the chance to respond — charging the renter's saved card for the documented amount. RentShift does not adjudicate fault, determine ultimate liability, or substitute for the parties' own insurance coverage.

7. User-to-User Disputes

Disputes between a renter and a host (over property condition, access, behavior, lost items, vehicle damage, or any other matter arising from the rental) are between those users. RentShift is not a party to such disputes. You agree that:

• You will attempt to resolve the dispute directly with the other user in good faith.
• RentShift may, at its sole discretion and only after verifying proof submitted by both sides, provide supporting documents — such as identity verification status, insurance verification status, booking timestamps, payment records, and uploaded evidence — to assist resolution.
• RentShift's provision of supporting documents is administrative only and does not make us a party to your dispute, nor does it constitute an admission, finding, or determination of fault.
• You will pursue any insurance claim through your own carrier, and you will not name RentShift in any litigation, arbitration, or insurance claim that arises solely between you and another user, except as permitted under Sections 9 (Limitation of Liability), 10 (Indemnification), and 12 (Mandatory Arbitration).

8. Prohibited Uses

• Storing hazardous, illegal, or stolen materials
• Living, sleeping, or operating a business in a rented space
• Performing mechanical repair work in a residential rented space
• Subletting rented spaces without host permission
• Listing a space you do not own or are not authorized to rent
• Using the platform to circumvent direct payments off-platform
• Providing false identity or verification documents
• Harassing, stalking, threatening, or otherwise harming another user

9. Limitation of Liability

To the maximum extent permitted by applicable law:

• RentShift, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including lost profits, lost data, or loss of goodwill — arising out of or related to your use of the platform.
• RentShift's total cumulative liability to you arising out of or relating to these Terms or your use of the platform — whether in contract, tort, warranty, or any other theory — shall not exceed the greater of (i) the total fees you paid to RentShift in the twelve (12) months preceding the event giving rise to the claim, or (ii) one hundred U.S. dollars ($100).
• RentShift is not responsible for property damage, vehicle damage, theft, loss of access, personal injury, lost or damaged contents, or any direct loss arising from a rental transaction. Such losses are the responsibility of the renter, the host, and their respective insurance carriers.
• You acknowledge that RentShift's pricing reflects this allocation of risk and that without these limitations the platform would not be commercially viable.

Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions our liability is limited to the smallest amount permitted by law.

10. Indemnification

You agree to defend, indemnify, and hold harmless RentShift and its officers, directors, employees, and agents from and against any and all claims, demands, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the platform; (b) your violation of these Terms; (c) your rental transactions, communications, or interactions with other users; (d) your violation of any law or the rights of any third party; (e) any content or documents you upload; (f) damage you cause to a host's property or to a renter's vehicle; or (g) any claim by a third party (including an HOA, landlord, municipality, or insurance carrier) arising from your listing or use of a space. RentShift reserves the right to assume the exclusive defense of any matter for which we are entitled to indemnification, in which case you will cooperate with our defense.

11. Account Suspension & Termination

RentShift may suspend or terminate your account at any time, with or without notice, if we believe in good faith that you have violated these Terms, provided fraudulent information, harmed another user, or exposed RentShift to legal or financial risk. You may terminate your account at any time by contacting us. On termination, your right to use the platform ends immediately. Sections that by their nature should survive termination — including Sections 6 (Damage), 7 (Disputes), 9 (Limitation of Liability), 10 (Indemnification), 12 (Arbitration), and 13 (Governing Law) — survive.

12. Mandatory Arbitration & Class-Action Waiver

Please read this section carefully — it affects your legal rights.

You and RentShift agree that any dispute, claim, or controversy arising out of or relating to these Terms, your use of the platform, or any rental transaction (a "Dispute") shall be resolved exclusively by individual binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. Arbitration shall take place in Travis County, Texas, or by video conference at the arbitrator's discretion. Judgment on the award may be entered in any court of competent jurisdiction.

Before initiating arbitration, you agree to first notify RentShift of the Dispute in writing at [email protected] and to attempt good-faith informal resolution for thirty (30) days.

Class-Action Waiver. All Disputes must be resolved on an individual basis. You and RentShift waive any right to participate in a class action, consolidated action, or representative action. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding.

Carve-outs. Notwithstanding the above, either party may (a) bring an individual claim in small-claims court that has jurisdiction; or (b) seek injunctive or equitable relief in court for the protection of intellectual property or for emergency matters that cannot wait for arbitration.

13. Governing Law & Venue

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Subject to Section 12 (Mandatory Arbitration), exclusive venue for any matter not subject to arbitration shall be the state and federal courts located in Travis County, Texas, and you consent to personal jurisdiction in those courts.

14. Changes

We may update these terms. Continued use after changes constitutes acceptance. Material changes will be communicated via email at least thirty (30) days before they take effect.
